NOTICE OF ACCEPTANCE OF DRAFT ENVIRONMENTAL IMPACT STATEMENT AND NOTICE OF PUBLIC HEARING AND COMMENT PERIOD.

Please be advised that the Town of Claverack Zoning Board of Appeals as lead agency has accepted the Draft Environmental Impact Statement upon the application from the Claverack Housing Ventures, LLC for the project known as the Stewardship at Millbrook Road, a Type I SEQRA action. The proposed action consists of coordinated review before the Town of Claverack Planning Board and Zoning Board of Appeals for a major subdivision, planned residential development with special use permit and site plan review; allowing other permits, approvals and compliance determinations by other involved agencies to authorize a major subdivision/planned residential development on Millbrook Road within the Town.

The Draft Environmental Impact Statement is intended to identify and address areas of possible significant environmental impacts, and is available for public review and inspection at the Claverack Town Offices, Claverack Library, and Philmont Library, during regular business hours.

Advertisement for Public Meeting No. 2, 11/16/05.

The New York State Office of Parks, Recreation and Historic Preservation (NYSOPRHP) will conduct a second Public Meeting for the Harlem Valley Rail Trail project (PIN 8756.44) on Wednesday, November 16, 2005, at the Taconic Hills High School, located in Craryville, New York. The project begins at Mountain Road in the Town of Copake, and extends approximately 22.7 miles northerly along the rail bed of the abandoned Harlem Valley Railroad to the Village of Chatham.

The purpose of this project in particular is to develop a continuous trail route concept from adjoining and willing property owners, toward the development of design process documents which will position the project for additional funding toward final design and trail construction.

The meeting is open to the general public. This meeting will primarily focus on the proposed trail path, in particular as it relates to adjacent properties and also how it has been routed along the public roadways were required. This meeting will afford attendees the opportunity to discuss comments with the NYSOPRHP and Consultant personnel. Additional public meetings are anticipated in the coming months, so that further public comment can be obtained.

Project Description: The applicant proposes a new discharge of 4,500 gallons per day of untreated brine waste water, to the Claverack Creek, from a new water softener unit, at the applicants facility to be located on Webb Rd., in the Town of Claverack, Columbia County. The applicant proposes to operate a water softener unit to treat a new water supply for the Town of Claverack Water District No. 1 The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 Office. Refer will require an Article 15 permit for the disturbance to the bed and banks of the Claverack Creek due to the construction of an outfall pipe and rip-rap bank stabilization.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Claverack Town Board

State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (ORRHP) has determined that the proposed activity will have no impact on registered or eligible archaelolgical sites or historic structures. No further review in accordance with SHPA is required.

RESOLUTION NO. 38

At a special meeting of the Town Board of the Town of Claverack, Columbia County, New York, duly held on the 25th day of April 2005, at the Town Hall, NYS Route 217, Mellenville, New York, the following Resolution and Order was proposed and seconded:

Seconded by: James Van Deusen.

WHEREAS, the Town Board of the Town of Claverack, New York (the "Town"), directed Clough, Harbour & Associates, LLP the Town Engineer, to prepare of a map, plan and report for providing the facilities. improvements and services in a portion of the Town wherein the Claverack Water District No. 1 was proposed to be established. and

WHEREAS, the scheduled improvements are as follows: the establishment of a water district to supply potable water to Claverack residents within the district, specifically through the purchase of water from the neighboring Town of Greenport. Said district will cause the installation of new 12-inch diameter and 8-inch diameter main lines for water distribution intended to service the lands within the district. Additionally, the district will contain a new 200,000-gallon elevated water storage tank and booster pump station to ensure the proper volume and pressure to the district, and

WHEREAS, after the map, plan and report for said district was filed in the Office of the Town Clerk, the Town Board did on November 10, 2003 adopt an order creating said water district and further setting the matter for public referendum, and

WHEREAS, on January 12, 2004 the Town placed the determination of the creation of the water district to a public vote, of the 176 persons that voted, 129 voted in favor of the creation of the district, and 47 were opposed, and

WHEREAS, the Claverack Water District No. 1 was thereby duly and property formed. and

WHEREAS, the Town placed the project out to bid, and the resultant bid costs have exceeded the initial estimate of $4,067,000 to an amount of $4,720,000, and

WHEREAS the Town desires to continue the project and pursuant to New York Town Law section 209-h the Town duly noticed a public hearing on the issue of the increased costs for the 25th day of April, 2005, at 7:00 o'clock P.M., at which time and place all persons interested in the subject of the cost increases having been heard, and

NOW, THEREFORE, IT IS, ORDERED:

  1. The notice of hearing was published and posted as required by law and is otherwise sufficient.
  2. That all of the property and property owners, within the Water District are benefited thereby.
  3. That all of the property and property owners benefited are included within the proposed Water District.
  4. That it remains in the public interest to establish the proposed water district.
  5. The maximum amount proposed to be expanded for such improvement is increased from an amount of $4,067,000 to an amount of $4,720,000.
  6. The total project cost of $4,720,000 will be financed by the New York State Environmental Facilities Corporation (EFC) and the State Department of Health through the New York State Drinking Water State Revolving Fund (DWSRF) by issuance of a $2,000,000 grant and $2,720,000 interest free loan for a 30-year time period.
  7. A detailed explanation of how the estimated cost of the District to the typical property owner is included in the Map, Plan and Report, which is on file with the Town Clerk and Available for public inspection. The bid information leading to the cost increase is also on file and available for inspection.
  8. That this Order is subject to a permissive referendum in the manner provided in Town Law Article 7 and Town Law § 209-e(3).

Upon question of the foregoing Resolution, the following Town Board Members voted "Aye" in favor of the Resolution:
James W. Keegan; William L. Blaauw; James Van Deusen;

The following Town Board Members voted "No" in opposition thereto:
None

The Resolution and Order having been approved by a majority of the Town Board, the same was declared duly adopted by the Supervisor of the Town of Claverack.

RESOLUTION NO.37

At a regular meeting of the Town Board of the Town of Claverack, Columbia County, New York, duly held on the 11th day of April 2005, at the Town Hall, NYS Route 217, Mellenville, New York, the following Resolution was proposed and seconded: Resolution by: William Blaauw; Seconded by: James Van Deusen.

WHEREAS, the Town Board of the Town of Claverack, New York (the "Town"), directed Clough, Harbour & Associates, LLP the Town Engineer, to prepare of a map, plan and report for providing the facilities, improvements or services in a portion of the Town wherein a water district was proposed to be established, and on the 23 day of September, 2003, said map, plan and report was filed in the office of the Town Clerk, and

WHEREAS, the improvements proposed are as follows: the establishment of a water district to supply potable water to Claverack residents within the district, specifically through the purchase of water from the neighboring Town of Greenport. Said district will cause the installation of new 12-inch diameter and 8-inch diameter main lines for water distribution intended to service the lands within the district. Additionally, the district will contain a new 200,000-gallon elevated water storage tank and booster pump station to ensure the proper volume and pressure to the district, and

WHEREAS, after the map, plan and report for said district was filed in the Office of the Town Clerk, the Town Board did on the 13th day of October 2003, adopt an order setting the matter for public hearing, the Town board conducted a public hearing on the 30th day of October 2003, the Town elected to submit the matter to a public vote, and

WHEREAS, on January 12, 2004 the Town put the creation of the water district to a public vote. Of the 176 persons that voted, 129 voted in favor of the creation of the district, and 47 were opposed, and WHEREAS, the Town put the project out to bid, and the resultant bid costs have exceeded the initial estimate of $4,067,000 to an amount of $4,720,000. Pursuant to New York Town Law section 209-h the Town will conduct a further public healing as to the cost increase to determine whether the project remains in the best interest of the proposed district users.

WHEREAS, it is proposed the maximum amount proposed to be expended for such improvement is $4,720,000, and is to be financed as follows: of the total project cost of $4,720,000 the New York State Environmental Facilities Corporation (EFC) and the State Department of Health through the New York State Drinking Water State Revolving Fund (DWSRF) will issue a $2,000,000 grant and $2,720,000 interest free loan for a 30-year time period, and

WHEREAS, the costs for the estimated hook-up fees for residents in the district will vary greatly due to distance form the main, type of terrain, accessibility and other factors, an estimate of $15.00 per foot can be used. arriving at an estimated cost for a house requiring a 100 foot service a $1,500 to connect to the district line. Additionally, the first year annual water used costs to the typical resident are projected at $618.00

ORDERED, that the Town Board shall meet at the Town Hall, New York, on the 25th day of April, 2005, at 7:00 o'clock PM., for the purpose of conducting a public hearing on the proposal to establish said district with the improvements specified above, at which time and place all persons interested in the subject thereof may be heard concerning the same, and it is further

ORDERED, that the Town Clerk is hereby authorized and directed to publish a copy of this order in the Register Star, the official Town newspaper and post a copy of the same on the signboard of the Town, in the time and manner required by law.

Upon question of the foregoing Resolution, the following Town Board Members voted "Aye" in favor of the Resolution: James W. Keegan; Anne Twaddle; James Van Deusen; William L. Blauw; and Clifford Weigelt. The following Town Board Members voted "No" in opposition thereto: None. The Resolution having been approved by a majority of the Town Board the same was declared duly adopted by the Supervisor of the Town of Claverack.
